18 U.S.C. § 2257 Statement
Our recordkeeping and real-performer policy for an AI-generated photorealistic platform.
ImageFap publishes synthetic and drawn artwork, not explicit photographs or recordings of actual human performers. Real-person explicit content is prohibited. Because there are no human performers in operator-created synthetic images, there are no performer records for that material. Any future covered content would require a verified records program and a real custodian address before publication.
This summary is for convenience. The complete provisions below control.1. Nature of the Service
ImageFap is designed as an artificial-intelligence image-generation service and a public library for fictional, drawn, photorealistic, photo, and photo-style artwork. Operator-created images are generated digitally and are not photographs or recordings of actual human performers engaged in actual or simulated sexually explicit conduct.
ImageFap does not employ, hire, contract with, direct, photograph, film, or record human performers for sexually explicit productions.
2. Statement concerning 18 U.S.C. §§ 2257 and 2257A
Under 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75, a producer of a visual depiction of an actual human being engaged in actual sexually explicit conduct, or in simulated sexually explicit conduct, must ascertain and record the performer's identity and date of birth, maintain those records, and post a statement saying where they are kept. "Sexually explicit conduct" takes the meaning given in 18 U.S.C. § 2256(2).
The position ImageFap takes
The images the Service produces are generated wholly by AI models from written prompts. There is no performer: No person is photographed, filmed, recorded or depicted. Where a depiction does not portray an actual human being, ImageFap understands that no performer exists whose identity and age could be ascertained, that no records within the meaning of Part 75 can come into existence, and that the record-keeping and labelling obligations are therefore not engaged.
This is a statement of the basis on which the Service operates. It is not a determination by any court or agency, and it does not extend to any material that does depict a real person. The obligations turn on the facts of a given depiction, and our prohibition on real-person explicit content in section 3 is what keeps those facts as described.
If that ever changes
Should ImageFap at any point permit material depicting actual human beings in covered conduct, we will designate a custodian of records, collect and maintain the records Part 75 requires before publication, and amend this statement with the custodian's name and business address before any such material is accepted.
2b. Synthetic depictions of minors are separately criminal
The absence of a real performer does not make an image lawful. 18 U.S.C. § 1466A criminalises obscene visual depictions of minors engaged in sexually explicit conduct including drawings, cartoons, sculptures, paintings and computer-generated images, whether or not any real child was involved in making them. Comparable offences exist across the European Union under Directive 2011/93/EU and in most other jurisdictions where the Service can be reached.
ImageFap prohibits any sexualised depiction of a minor or of a character who reads as one, absolutely and without exception. Prompts that read as underage are refused before a render begins rather than filtered afterwards, our own prompt tooling defaults to mature adults well above the legal threshold, and age-ambiguous output is removed on review. Apparent violations are reported to the National Center for Missing & Exploited Children and to competent authorities as required by 18 U.S.C. § 2258A and applicable EU law, and the account is terminated.
3. Real-person explicit content is not permitted
ImageFap does not authorize users to upload, generate from, edit, or publicly post photographs, video frames, scans, deepfakes, face swaps, or other sexually explicit depictions of an actual or identifiable human being. This prohibition applies even if the person is an adult, consented elsewhere, or is claimed to be a model, celebrity, creator, or the uploading user.
Reference-image and editing tools are not permission to submit real-person explicit material. Content that appears photographic, live-action, derived from a real person's intimate image, or otherwise likely to involve an actual human performer may be blocked, quarantined, or removed.
4. User-generated material
Users are independent content submitters and are responsible for every upload and publication. They must comply with the Terms of Use, Safety Standard, this Statement, and all applicable recordkeeping, consent, privacy, and criminal laws.
No user may rely on this Statement as a substitute for records they are legally required to create or maintain. A user's label, age claim, disclaimer, or assertion that material is “AI” does not establish that an actual person was not used. We may demand provenance information, source files, written certifications, or other evidence and may remove material when its origin cannot be verified.
5. No covered-content records custodian at present
Because the Service presently prohibits publication of sexually explicit depictions of actual human performers and operator-created material is synthetic, ImageFap does not presently designate a §2257 custodian or records address for such prohibited material.
If ImageFap ever elects to publish content for which it is legally required to maintain performer records, it will establish the required verification and recordkeeping program and publish the custodian's accurate name, title, and physical street address before that content is made available. A post-office box or invented placeholder will not be used.
6. Age and consent standard
Every sexualized character must be unmistakably an adult. ImageFap prohibits minors, young-looking or age-ambiguous characters, age-regression themes, “barely legal” framing, child sexual abuse material, and any attempt to evade age safeguards. Merely stating “18+” in a prompt does not cure a youthful depiction.

7. Reporting questionable material
If material appears to depict an actual person, a minor, an age-ambiguous person, trafficking, non-consensual conduct, or other prohibited content, use the Report button on the artwork or email [email protected]. Include the exact URL or content ID and the reason for concern. Do not download, redistribute, or attach suspected illegal imagery unless specifically instructed by competent authorities.
We may disable access, preserve relevant account and technical records, investigate provenance, terminate accounts, and report apparent criminal conduct when required or appropriate.
